This research has as its object of study the management of early childhood education in Alagoas and the guarantee of the right to education for children from 0 to 5 years old, considering the advances and obstacles resulting from municipalization policies and financing for the stage, with the objective of analyzing the realization of the right to education for children from 0 to 5 years of age, based on historical and conjunctural aspects of public policies for early childhood education instituted within the scope of the management, municipalization and financing of early childhood education in Alagoas, based on the Federal Constitution of 1988. Taking into account the theoretical and legal aspects in the field of early childhood education in the last three decades, the research seeks to answer to what extent the State of Alagoas has corresponded to guaranteeing the constitutional right to early childhood education for children from 0 to 5 years old and materialized, in results, the educational policy in this stage of basic education. To this end, the thesis is structured around discussions about the historical-cultural concepts of childhood, children and child development, covering the processes by which childcare and the social right to education were constituted in public policies of the Brazilian State in the context of public management, financing and municipalization processes of the stage. As a basis for the research, the theoretical framework was based on studies on the social history of childhood and on early childhood education, having as main sources Ariès (1981), Kuhlmann Jr. (2003; 2015), Dalbosco (2007), Rosemberg ( 2002; 2005), Campos, Rosemberg and Ferreira (2001), Kramer (2006; 2011), Campos and Ramos (2018), Haddad (2007; 2017), Didonet (2001), Carijo (2005) and Vigotski (2000); in studies on the State, educational public policies and public management, whose sources were Santos (2012), Bobbio (1998), Höfling (2001), Azevedo (2001), Neves (2005), Frigotto (2011), Boito Jr. (2002; 2016), Parente and Villar (2020), Oliveira (2015), Ball (2018), Nunes, Corsino and Didonet (2011), among others; and studies about decentralization, financing, municipalization and quality of education from Pinto (2012; 2014; 2018), Davies (2008), Macedo and Alves (2011), Farenzena (2020); Fernandes, Gimenes and Campos (2013), Souza and Faria (2001), Martins (2010), Cara (2012, 2014), among others. As a methodological reference, the study is a qualitative research, with a theoretical-methodological approach based on historical dialectical materialism, structured in documentary research, about the official documents of the federal, state and municipal spheres on early childhood education, and in field research. , through interviews with the child education coordinators of the education departments of the investigated municipalities. The data were analyzed using Content analysis in Bardin (1977). The results indicate that, in Alagoas, the instituted early childhood education policy reaps modest advances and still many obstacles, in the last three decades. The policy of municipalization, financing and management have not guaranteed that the municipalities will meet the goals of meeting demand, denying a significant portion of children, especially those aged 0 to 3 years, the right to educational assistance. There is still a long way to guarantee universal service and an early childhood education project that respects the specificity of early childhood and consolidates the care and education of the child in an inseparable, integrated and shared way between the State, society and family, and that ensures a continuous and global process of integral development to all of them. The state of Alagoas has failed to guarantee access, the inadequacy of physical spaces and material and human resources, the implementation of the social policy for the legitimation of children subject to the law.
