POLITICAL RIGHTS IN THE LIGHT OF INTERPRETATION METHODS:
THE PROBLEM OF THE EXTENSION OF REFLEX INELIGIBILITY

The research analyzes, based on interpretation methods, what is the extent of reflex ineligibility provided for in art. 14, § 7, of the CRFB/88, in particular, what is the scope of the expression "in the territory of jurisdiction of the holder" contained in the article.
It is demonstrated during the research how the perpetuation of family groups can offend principles such as republican and democratic.
Likewise, considering that reflex ineligibility is also a restriction to a fundamental political right (the right to be voted), we seek to establish objective filters and criteria for the application of this restriction.
Administrative modifications that can expand the jurisdiction space of the holder of an elective mandate are also highlighted.
