SUMMARY:

This dissertation aims to provide a critical reading of the importance attributed to the social function of paternity in today's legal system, analyzing it from the perspective of a father's duty and a child's right, based on the doctrine of full protection, but, also, as a fundamental human right to care, to dignify themselves through self-determination and the freedom to exercise care for the child, developing their parenting skills in this process from the same protection intended for motherhood. The constitutionalization of private law constitutes the theoretical framework of the investigation, an indispensable methodology for understanding the right to care as a personality right, whose deprivation prevents human beings from achieving their full development. Observing the relevance of the father's place, it promotes the reparation of the discrimination suffered by the woman who infringes the right to seek full employment, as a penalty for motherhood and the disproportionate division of domestic care, remnants of a time, already outdated, based on supposed gender roles. Analyzing the state of the art of maternity and paternity protection, its anachronisms are verified and a possible solution that does not expect to be provided by the Social State, but by a solidary society, one of the fundamental objectives of the Federative Republic of Brazil, is highlighted. The participation that is invoked is related to the company's social function, which, exercising its social responsibility, can encourage the complete abandonment of this inequality that still exists between men and women when they become parents. And from this propositional perspective, the Stakeholders Theory proves to be an important and compensatory ally in the construction of a free, fair and solidary society, a real win-win for everyone.
