SUMMARY:

This study addresses the paradox between the right to migration inherent to refugees and the issue of public health, given the measures restricting the movement of people adopted during the Covid-19 pandemic, particularly border closures. The objective is to analyze the impacts of these restrictions on the guarantee of fundamental rights for these individuals, especially regarding the right to mobility. This research examines the legal foundations, as well as the principles that underpin the right to migration and mobility, along with the motivations behind the border closure measures adopted in the name of public health. Furthermore, it seeks to understand the challenges faced by refugees amidst these restrictions, including the potential exacerbation of human rights violations they endure. This study employs a historical-materialistic method, as well as exploratory research, and critically and comparatively analyzes primarily from a perspective of legality and proportionality, considering the insights of Virgílio Afonso da Silva. It examines measures restricting the movement of people, particularly border closures, adopted both globally and in Brazil, comparing the adoption of these measures and their impacts on the national territory with those taken by other Latin American countries such as Venezuela, Argentina, and Paraguay, as well as New Zealand, considering the latter country's positive outcomes in combating Covid-19. The study aims to contribute to the academic, legal, and social debate on the proportionality and effectiveness of border closure measures, as well as the reconciliation of the right to migration with legitimate public health concerns, especially during times of global health crises. The results of this study may be relevant for policymakers and other professionals in developing proportional and effective approaches to address the challenges faced by refugees during global health crises while preserving fundamental rights, as well as the commitments assumed by Brazil regarding refugee protection.
