SUMMARY:

Legal and social discourse are fundamental to the formation of Brazilian society, being able to produce different effects of meaning, based mainly on issues related to gender, capitalism, social sexual division of labor, and violence against women. Violence against women is a social problem that derives from the structure of praxis and is established from established relations and institutionalized forms, through discursive and ideological functioning. This dissertation analyzes the official legal discourse, Maria da Penha Law 11.340/2006 and the Feminicide Law 13.104/2015, in contrast to the social discourse of data on violence against women, which materialize in favor of an effectiveness or negligence in eradicating this problem. Thus, we researched the theoretical framework of the Pêcheuxtian Discourse Analysis (DA) with a materialist-historical basis and the texts of Orlandi (1999[2020]) to support and ground the research, thus analyzing the meanings that are anchored in the discourses from certain conditions of production. In addition, the theoretical contributions of Biroli (2018), Saffioti (2015), Marx (2014), Lukács (2013), Magalhães (2010), etc. to discuss and analyze labor relations, ideology, places/gender, classes, violence, and ideology. With the aim of analyzing the effects of meaning that are constructed through the Laws in counterpoint to the data, showing which are the main threads of the discourse and how in the materialities under analysis the effectiveness or negligence contribute to the increase of the data on violence against women and to the construction of the binary and biologist stereotype about being a Brazilian woman.
