SUMMARY:

This research is presented under a rhetorical-argumentative perspective, in which the objective is to analyze the way in which pathetic discourse is rhetorically manifested through the oral discursive genres, accusation and defense, in the Jury Court, seeking to understand how the passionate elements can be a resource used by speakers to achieve their persuasive intent in the genres under study. Therefore, the analyzes were based on the theoretical postulates of Aristotle (Rhetoric, II) and Meyer (1991, 2000), to support the study of rhetorical passions; as well as on those of Ferreira (2010), Mateus (2018), Perelman and Olbrechts-Tyteca (2014) and Reboul (1998) to support issues related to Rhetoric in general, and also on Marcuschi (1998) and Preti (1998), whose teachings form the basis on which the transcripts were made. Thus, the systematizing of the Rhetoric by Aristotle (384-322 BC) – with the presentation of the 14 (fourteen) passions and the development of a structure for the analysis of these passions based on three fundamentals, namely: in which disposition is the one who feels the passion, against whom one feels, and, finally, in what circumstance the passion presents itself – added by Meyer’s (2000) later considerations, base the research with regard to the rhetoric of the passions. To what relates to the corpus, 3 (three) hearing sessions of the Popular Jury were selected and transcribed, in which the genres accusation and defense were present. For this research, 6 (six) fragments were removed, which were used for the analyses. Such analyzes were carried out based on the teachings of Leach (2008), who instituted four steps for the rhetorical research, founded on a process based on the theory of stasis (LEACH, 2008).  Along this path, the recurrence of passions such as compassion, hate and fear was observed as the main passions identified in the analyzed rhetorical acts. The work continued, in this sense, with the observation of these passions in search of the understanding on what they contribute to the persuavive construction, analyzing Rhetoric as an art of persuading not by any discourse, but by an eminently passionate discourse, as it seems to be the case of the discourse explored in the genres in question.
