SUMMARY:

The purpose of this paper is to analyze the influence that specialization through attendance in postgraduate
courses (strictu sensu) abroad can have on intellectual property in Brazil (patents granted in the last 10 years
to Brazilian Universities). In this sense, a review of the process of recognition of foreign postgraduate degrees
in Brazil was carried out, a necessary step for the use of the qualification in master's and doctoral degrees.
After that, a case study was carried out, based on data collected at the Federal University of Alagoas (Ufal),
in the last 10 years, in order to understand the profile of requests for recognition of postgraduate courses
(Masters and Doctoral degrees ) and the main obstacles to the granting of recognition, in order to have a more
general view of the difficulty of working for professionals studying postgraduate studies abroad. Finally, a
search in the INPI (National Institute of Intellectual Property) to draw a profile of patents granted to Brazilian
Universities in the last 10 years, aiming to verify whether or not inventors have postgraduate degrees abroad
and whether this aspect would be correlated with a promoting factor in intellectual property in the country.
Regarding UFAL, 372 requests for recognition processed between the years 2011-2019 were examined (after
the start of the pandemic - COVID-19, they were suspended), with peaks of requests in the years 2015 and
2018 with 104 processes. More than 80% of the processes were from courses carried out in Paraguay and
Portugal, and more than 90% in the area of education, with the remaining areas with a representative of less
than 3% (for example, Law, Biotechnology, Economics, etc.) . 52.95% of cases were recognized between 06
months to 1 year, while 47.04% over 1 year, 8.33% over 2 years, and in some cases, up to more than 4 years,
showing that the process can be very bureaucratic. Of the patents granted to Universities, there was a total of
1072 patents that will be analyzed for the defense.
