EXPLORATORY STUDY OF THE POTENTIALITY OF THE GEOGRAPHICAL INDICATION OF MATE PARAGUAIA HERB

This final course project, whose objective is to raise legal aspects and the situation regarding the geographical indication of yerba mate "illex paraguayensis" in Latin America and particularly in Paraguay through a compilation of data on patents and scientific articles developed with yerba mate from countries such as Japan, the United States and Latin American countries, a review of relevant legislation for geographical indications in Latin America and a critical analysis of geographical indications close or similar to yerba mate in Latin America, is presented as a work that consists of a systematic review of the literature that was approached with a mixed, exploratory, non-experimental investigation, collecting the necessary data to demonstrate the current state of the geographical indications of Paraguayan yerba mate. The amount of sample consists of 200 to 300 combined scientific articles and patents that were consulted from high-impact bibliographic sources on intellectual property such as Scielo, ScienceDirect, Scopus, Web of Science, INPI, DINAPI, LATIPAT, Derwent and Orbit that contain the following keywords: "yerba mate", "illex paraguayensis", "erva mate", "mate herb" and the combination between them. The results showed that the countries in the region with the largest scientific articles and patents are in Brazil, but in relation to patents there are also countries such as the United States and Japan. This work showed that Paraguay needs to improve the quality of research regarding yerba mate and strengthen everything related to the protection of products and services originating in the country with the protection of geographical indications, especially the importance of the potential of Yerba Mate as a Geographical Indication of Paraguay.
