SUMMARY:

This monograph aims to analyze the legal and technical feasibility of using Smart Contracts in
Blockchain in order to provide more security, efficiency and decentralization in the hiring of workers.
Initially, concepts, structure and justifications for the adoption of blockchain technology will be
presented, as well as the barriers that the use of this technology faces. Blockchain smart contracts,
their importance, usefulness and barriers to their adoption will also be addressed. Afterwards, the
entire panorama and legal basis referring to employment contracts will be traced, passing through
the general theory of contracts, their inherent concepts and principles, and a brief description about
employment contracts, including their concept, characteristics, essential elements, modalities and
how its formalization takes place. Then a prospective study will be presented, in articles from
renowned scientific bases, and patents, about what exists today in the world in relation to smart
contracts acting in contracts in general. Finally, conclusions will be made about the technical and
legal feasibility of adopting smart contracts with employment contracts. For this, we will use with
foundation, all the dissertation text presented, and, still, a research will be made of everything that
exists today that uses blockchain technology, in the federal sphere. Projects that already use the
technology and the possibility of adapting its use to employment contracts will be researched,
analyzing all the difficulties and limitations that may arise, as well as explaining the facilities for its
adoption, if any. Finally, the possibility of an integrative ecosystem involving e-social, digital CTPS
and blockchain employment contracts will be analyzed, generating more legal security for the
worker. This scientific work will also be complemented with another product, which will be the
elaboration of a blockchain technology adaptation manual along with work contacts. For this, the
essential elements were identified for the development of an application that allows smart contracts
to legally and technically adapt to the hiring of workers, with the peculiarities inherent in the work
regime that will be provided. The methodology used in this study is deductive and with some case
studies, based on descriptive research of the concepts involved in Blockchain, Smart Contracts and
employment contracts.
