SUMMARY:

This thesis brings as a research object the social complex of law and its functionality in class society. Therefore, the investigation process was based on bibliographical research, using the resource of immanent analysis of some authors. Initially, we start from the Marxian-Lukacsian perspective that elucidates the categorical complexity of being in its immanent legalities. This method allowed us to understand the social totality and the complexes that
emerge within it, which have a direct or indirect mediation with the Marxian category of work, the latter being understood as a specific legality of the social being. From the assumption of work and its growing development, the social being becomes more complex and reaches civilizing levels that demand the emergence of new social complexes, of which the object in question is inserted. From this, we sought to demystify the fetishizing content that law acquires in class society, especially in bourgeois sociability, becoming one of the main mechanisms for legalizing the inequality established between capital and work. In the meantime, its necessary symbiosis with the modern State naturalizes the social antagonisms that are not natural at all, rather, they are the result of human self-activity. In this sense, the social functionality acquired by law places it at the level of a restricted ideology.
