SUMMARY:

The “return” of children and adolescents in the process of adoption in
Brazil has pointed to the need for research and problematization on the theme, in front of
an institute built to promote the best interest of the children, considering them as subjects
of rights and people in peculiar condition of development, but which denounces a system
that is still fragile, triggered by cases of unsuccessful profiling, especially with regard to
the adoption of children older than two years, as well as adolescents. Thus, this research
aims to investigate the factors related to the waiver of the affiliation process in cases of
adoption, and the consequent "return" of the child/adolescent during the coexistence stage.
To this end, the data collection methodology was the documental analysis, whereby legal
proceedings in which the adoption was not successful will be examined. The locus of the
research is the Children and Juvenile Court of a tribunal in the Brazilian Northeast. At
first, the selection of ten different processes will be sought, which will undergo a
treatment and will be transformed into cases, interpreted in the light of Donald Winnicott's
psychoanalysis and under the prism of the following guiding question: what are the
factors that contribute to the “return” of children/ adolescents during the coexistence stage
in the adoption process? To date, 7 (seven) cases have been collected and are in the
process of analysis. Some hypotheses indicate that these applicants for adoption, when
faced with a “return”, feel that they have not found the idealized child; present great
difficulty in dealing with the past history of the adoptees or blame them for “bad”
behavior. Furthermore, the academic literature also points out reasons why some
postulants decide to adopt, experiencing a certain sense of "charity" or "altruism", of
which, the "rebellious" children become unworthy, promoting their "return". It also points
out that there may be an overload of technicians from the judiciary, who are unable to
work with these families in order to enable them with more sensitivity in listening, to the
point of not grasping their real motivations for adoption, as well as accompanying them at
that moment. indispensable, which is the coexistence stage. Therefore, looking at these
judicial documents and analyzing them can produce more assertive coping strategies and
support a new look at the problem.
