THE “RETURN” OF CHILDREN AND ADOLESCENTS IN THE PROCESS OF ADOPTION

The “return” of children and adolescents in the process of adoption in Brazil has pointed to the need for research and problematization on the theme, in front of an institute built to promote the best interest of the children, considering them as subjects of rights and people in peculiar condition of development. However, it also denounces a system that is still fragile, triggered by cases of unsuccessful tillering, especially with regard to the adoption of children over two years of age, as well as adolescents. Thus, this research aimed to investigate the factors related to the waiver of the affiliation process in cases of adoption and, consequently, the “return” of the child/adolescent during the cohabitation stage. The specific objectives were: to examine the past history of the “returned” child/adolescent; to point out reasons why the surrogate families opted for adoption; identify the justifications that contributed to the “return” of the child/adolescent; analyze the repercussions of the “return” phenomenon in the collected cases; and reflect on the contributions of the Judiciary and technical teams. For this, a qualitative approach was carried out, in which the study of cases constituted through documental analysis of legal proceedings in which the adoption was not successful was used as a method. The locus of the research was the childhood and youth court in a city in the Brazilian Northeast. Seven lawsuits were analyzed, which underwent treatment and were, thus, transformed into cases, through a specific methodology (case study), interpreted in the light of Donald Winnicott's psychoanalysis and under the prism of the following guiding question: which factors contribute to the “return” of children/adolescents during the cohabitation stage in the adoption process? For the analysis of the results, five categories were constructed based on the objectives and data collected, they were: (1) previous history of the adopted child; (2) reasons for foster families to opt for adoption; (3) justifications that led to the “return” of the child/adolescent; (4) repercussions of “devolution” in the lives of children/adolescents; (5) contributions from the Judiciary and technical teams in the adoption process and facing the “return”. The results showed (1) the importance of understanding and accepting the child/adolescent's past history adopted in the process of constituting the profiling and preventing “returns”; (2) that the reasons that lead applicants to adoption are important, but not defining success in the adoption; (3) confusion in affective and emotional communication between children/adolescents and prospective adopters, which demonstrates the need for specialized monitoring throughout the adoption process; (4) that the returns of children/adolescents have a negative impact on physical, psychological and emotional development in the short, medium and long term; and (5) that the Adoption Support Groups constitute themselves as fruitful places for extrajudicial listening and reception for successful adoption. This research sought to contribute to reflections on the adoption institute with a focus on the "return" of children and adolescents, without, however, exhausting the theme. Therefore, it is expected that it has broadened the view on the infant who experiences this phenomenon, in addition to helping professionals who need to deal with this reality.
