SUMMARY:

This is a critical, genealogical effort, starting from aspects of alterity as proposed by Emmanuel Levidas, in order to show that Brazilian positive law has “totalizing essence (s)”; that in its philosophical structuring aspects, there are doltrinal postulates that make a real relation of alterity impossible and that serve to maintain some power structures in society that parasitize legal aspects in order to perpetuate themselves. It is a critique of ontological legal-political instrumentalism, as well as of the philosophy of logos (reason) as a defining element of humanity. The study of alterity, in Levinas, is one of the vectors that makes it possible, in a more coherent way, to face the dilemma of living together amidst differences, in an open way, beyond the politically correct discourse, but empty of content. It is a search for ethical thinking about the relationship between ideology, politics, law, and humanity. The work questions whether the free exercise of reason is even the element that characterizes hummanity. One of the assumptions of the research is that contemporaneity keeps making the mistake of reducing people to the status of disposable things, and Levinasian ethies is one of the ways to highlight this evil. It is said that metaphysics has become the return to the request for justice, and this justice, in Levinas, has absolutely different roots from the ones preached until its philosophical appearance. The Levinasian justice proposal is made through a deeper reflection on unsustainability of the organization models (ssytems) that consider, above all, the exclusions generated by the misuse of otherness, considering that the capitalist model of
economic organization, subsidized by the need for constant production, imposes, in a distorted way, the idea of work and citizenship as a humanization factor and, thus, manufactures its dispensables. The contemporaneity begs for alternatives, and this dissertation seeks to investigate a normative-social organization, starting from the ethict of alterity, in opposition to the objectification of relations originating from a capitalized law, which seems to us na impediment to a greater effectiveness of the plurality of human rights, of content and not merely formal (of appearances); a structure out of sameness, which is done, with greater foundation, in the work Totality and Infinity (1980).
